1. Acceptance of Terms
By accessing and using Shift.mt ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.
2. Description of Service
Shift.mt is a workforce management platform that connects businesses in Malta's hospitality industry with licensed staffing agencies and their verified workers. We facilitate the matching, booking, time tracking, and payment processing for temporary staffing arrangements.
3. User Accounts
3.1 Account Registration
To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. User Responsibilities
4.1 For Businesses
- Provide accurate shift requirements and job descriptions
- Ensure a safe working environment for workers
- Pay invoices within the agreed payment terms
- Comply with all applicable employment and safety regulations
4.2 For Agencies
- Maintain valid employment agency licensing
- Ensure all workers are properly vetted and documented
- Comply with employment regulations and tax obligations
- Provide accurate worker availability and qualifications
5. Fees and Payment
Fees for using the Platform are outlined on our pricing page. Businesses agree to pay the platform fee plus the agency's worker rates. Payment terms are weekly unless otherwise agreed. Late payments may incur additional charges.
6. Intellectual Property
The Platform and its original content, features, and functionality are owned by Shift.mt and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7. Limitation of Liability
Shift.mt acts as an intermediary platform connecting businesses with staffing agencies. We do not employ the workers directly and are not responsible for the actions, conduct, or performance of workers or agencies. Our liability is limited to the fees paid to us for our platform services.
8. Dispute Resolution
Any disputes arising from the use of the Platform shall first be attempted to be resolved through informal negotiation. If resolution is not achieved, disputes shall be resolved through arbitration in Malta in accordance with Maltese law.
9. Termination
We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law provisions.
